Cannabinoids in Germany 2026: What's Legal, What's Not?

The German cannabinoid market has undergone fundamental changes in the last two years. New substances are appearing on the market at short intervals, laws are being adjusted, and grey areas are emerging and disappearing again. Anyone who wants to know what they can legally buy and consume needs up-to-date information – not half-baked posts from forums. This article gives you an objective overview of the legal situation in Germany as of 2026.

The starting point: What has changed since 2024?

With the partial legalization of cannabis in April 2024, Germany became the first major EU state to decriminalize private possession and cultivation of cannabis under certain conditions. Since then, adults aged 18 and over have been permitted to carry up to 25 grams of cannabis in public and store up to 50 grams at home.

That sounds clear – but in practice, it isn't always. Because parallel to classic cannabis, there is a growing market for alternative cannabinoids, to which the new law only applies to a limited extent. This article is all about that.

HHC – Hexahydrocannabinol

HHC was one of the first alternative cannabinoids to gain widespread attention in Germany. The legal situation was unclear for a long time. Meanwhile, it is understood that HHC itself is not explicitly prohibited in Germany, but it exists in a regulatory grey area. The method of production is crucial – synthetically produced HHC can fall under the New Psychoactive Substances Act (NpSG), while HHC derived from hemp is assessed differently.

Specifically: The purchase and possession of HHC products from reputable suppliers with proven origin from legal hemp have not yet been criminally prosecuted by authorities – however, there is no nationwide consistent legal interpretation by the courts yet.

THCA – Tetrahydrocannabinolic Acid

THCA is the non-psychoactive precursor to THC. In the raw, unheated plant, THC is almost exclusively present as THCA. Psychoactive THC is only formed when heated (vaporizing, smoking, decarboxylation).

This means legally: THCA itself does not fall under the BtMG. However, as soon as the flower is consumed – i.e., heated – THC is formed, and the same rules apply as with classic cannabis. T8HC – Tetrahydrocannabihexol

T8HC is one of the newer cannabinoids on the German market and is not yet explicitly listed by name in either the BtMG or the NpSG. This currently makes it one of the most legally uncomplicated alternative cannabinoids – as long as it is derived from legal hemp and the products meet all quality requirements.

9H-THC and 9H-HHC

9H-THC and 9H-HHC are also structurally modified cannabinoids that are not yet explicitly covered by a prohibition standard in Germany. They are created through chemical modification of the basic structure of known cannabinoids and were specifically developed to circumvent existing regulations – which is increasingly attracting the attention of authorities.

H3-Cannabis and H3 Flowers

What always applies – regardless of the substance?

Some rules apply equally to all cannabinoids, regardless of whether the substance is explicitly prohibited or not:

Minimum age 18. No legal provider in Germany sells cannabinoid products to minors. At Dampf21, age verification is mandatory before purchase.

No consumption in traffic. For all psychoactive cannabinoids, the same limits apply in traffic as for classic THC. If you're driving, don't consume – no exceptions.

No consumption near schools and daycares. The regulations of the Cannabis Act 2024 also apply mutatis mutandis to alternative cannabinoids for public consumption.

Shipping abroad is risky. What is legal in Germany may be prohibited in a neighboring country. Personal responsibility is required here – and when in doubt: do not ship.
